Any way you could let us know where to find this data?

As for the poor soul with the gall bladder, I thought the same thing several people here thought. Surgery is risky. This is unfortunate, but not every accident constitutes malpractice.Warrenhttps://www.blogger.com/profile/04304785587403573072noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-76179820785262116552009-10-06T11:52:04.399-04:002009-10-06T11:52:04.399-04:00Great post! In order to commit malpractice the doctor has to violate the standard of care which is defined as actions "a reasonable physician in similar circumstances" would take. So if they're just doing their job and something bad happens you have to prove that it isn't just "something that can happen" when performing procedures. You also have to prove that it was the violation of the standard of care that caused the injury and not some other factor.

It's also very difficult to prove economic loss. A child that is disabled by malpractice has no income, how do you calculate economic loss? It is a contentious point and a shortcoming there can often be made up in pain and suffering awards. Capping awards will have little to no effect on healthcare costs, it is simply the insurance companies trying to further their dominance over the plaintiff's bar.

On a similar subject, here's a link to an article on the lie of defensive medicine http://www.vamedmal.com/library/the-high-cost-of-defensive-medicine.cfmUnknownhttps://www.blogger.com/profile/02732740262445996717noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-8114111336460547812009-10-05T22:04:21.365-04:002009-10-05T22:04:21.365-04:00You raise some very good points, Jeanne; and you&#...You raise some very good points, Jeanne; and you'll get no argument from me!

PearlPearlhttps://www.blogger.com/profile/05261369905176088917noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-31354150274625260702009-10-05T21:16:27.546-04:002009-10-05T21:16:27.546-04:00All I know is that tomorrow's post possibly me...All I know is that tomorrow's post possibly means more to me than this one, as I'm unfamiliar with anything that's being discussed.

And I love coffee :)))♥ Brajahttps://www.blogger.com/profile/07693196044262677095noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-85528258336716752009-10-05T20:36:43.916-04:002009-10-05T20:36:43.916-04:00A great explanation of a very complex problem. I work in IT, I'm a good programmer - fast, efficient, quick to make decisions and generally I make the right call.

But sometimes I make the wrong call - I'm human and ultimately humans do make mistakes or errors of judgement.

Some would say "well those suckers shouldn't be surgeons or doctors" but ultimately any surgeon or doctor could make a mistake, and if they are human then they will. Some mistakes will be serious. That doesn't lesson the gravity of it, not at all, but I think that is what health insurance should be for, among other things.mo.stoneskinhttps://www.blogger.com/profile/10737422581378328590noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-1140898875496072582009-10-05T06:38:36.619-04:002009-10-05T06:38:36.619-04:00Thanks for the post... being out of the country, I...Thanks for the post... being out of the country, I am very much out of the loop and missing these discussions.Christine Gramhttps://www.blogger.com/profile/13783180729146518061noreply@blogger.comtag:blogger.com,1999:blog-4496267973912420638.post-1319556667236057122009-10-05T06:26:57.751-04:002009-10-05T06:26:57.751-04:00Fascinating. Being British, I know very little about the
US system, though the proposed reforms have been in the news a bit lately (in very high-level terms). I'm not sure what the problem is that this limit is proposed to fix, though - is it supposed to make the medical insurance premiums cheaper?Rachel Cotterillhttps://www.blogger.com/profile/08969719330048416996noreply@blogger.com
